Strange League Instructors Commission CD Statement

The disciplinary body held the League responsible for the staging of the match, a body which, according to Article 44(3) of the Competition Regulations, has the “possibility to change the date of a match in professional competitions”.

The Disciplinary Board (CD) of the FPF cleared Belenenses of the non-respect of regular time for the match with Benfica, on November 27, 2021, interrupted shortly after the start of the second half, for lack of players from the team blue.

The disciplinary body held the League responsible for the staging of the match, a body which, according to Article 44(3) of the Competition Regulations, has the “possibility to change the date of a match in professional competitions”.

The Commission of Instructors of the League had proposed the abandonment of the disciplinary procedure against Belenenses SAD, but this decision was not accepted by the CD, because “considering that the evidence produced in the instruction indicated that SAD had not requested the postponement of the match, despite, before it started, already being in possession of sufficient information to consider its possible early termination due to numerical insufficiency”.

The match between Belenenses and Benfica, in the 12th round of the current Liga Bwin, ended at 48′ (7-0), the hosts being left without a minimum of footballers, having started with only nine (including two guardians, in the face of the covid-19 epidemic.

Tonight, the La Liga Portugal Instructors Commission reacted to the Disciplinary Board by issuing a statement saying that the position of the FPF body is strange. “[…] It is not understandable that it is now affirmed, in a press release, the inexistence, in the procedure, of sufficient convincing elements to appreciate the veracity of the existence of such steps aiming at the postponement of the game “, perhaps we read.

“So that there is no misunderstanding as to the diligence of the Committee of Instructors (CI) in the processing of file no. 33-21/22 during the investigation phase, the following press release is issued:

During the investigation, CI promoted the evidentiary steps necessary to discover the truth about the possible request for the postponement of the match, namely the notification of SL Benfica SAD, the investigations of the referee and the League delegate concerning the preparatory meeting for the match, the investigation of the match delegate of Os Belenenses-SAD, having concluded that the postponement of the match had not been requested.

In view of the information available to it, CI therefore concluded that there was no proof that such a request for adjournment had been formulated formally or during a pre-match meeting, a conclusion which resulted, moreover, , the response of the referee and the delegate of the League, whose statements have, as we know, an enhanced probative value.

The Disciplinary Council of the FPF (CD) decided, contrary to what was proposed by the IC, to indict Os Belenenses-SAD, without omitting to mention, in this pleading: additional investigative diligence, since the file contains all the necessary and sufficient elements to rule on the existence of evidence of the practice of a disciplinary offence, i.e. they make it possible to determine the subsumption of reality incriminated and verified at a disciplinary offenses referred to in the Disciplinary Regulations (…)”.

Having legitimately, by a different legal interpretation, brought an accusation against Os Belenenses-SAD, but recognizing, in this accusation, the promotion of all probationary steps by the IC, it is not understandable that it is now affirmed, in a Press Release, the subsequent lack of sufficient evidence to assess the veracity of the existence of such steps aimed at postponing gambling.

Especially since the CD’s final disciplinary decision, while not based on the same terms, concludes along the exact lines proposed by CI.”
